Review of 'Activities on Thoroughfares and Trading in Thoroughfares and Public Places Local Law 2010'

The Local Government Act 1995 requires local governments to review their local laws every eight years to make sure they are still current and fit for purpose. The Town of Bassendean is proposing to review the Activities on Thoroughfares and Trading in Thoroughfares and Public Places Local Law 2010.

Following this initial consultation phase and consideration of feedback received, a draft amended Local Law will be considered at a future Council meeting, prior to release to the public for a second consultation phase. Click here for more information.

DAP Application - Proposed Child Care Premises - Lot 85 (No. 94) West Road, Bassendean

An application has been made to develop a Child Care Premises at Lot 85 (No. 94) West Road, Bassendean (corner of West Road and Bridson Street). The application will be determined by the Metro Inner Development Assessment Panel (DAP). The proposed Child Care Premises involves:

  • A 2-storey, purpose-built Child Care Premises capable of accommodating up to 80 children (0 to 5 years old) and 13 staff;
  • Childcare services to be provided Monday to Friday between 7.00am and 6.30pm;
  • 15 onsite car parking bays, accessed via West Road.

The Town has received a development application for a retrospective Change of Use at Units 3 & 4, 27 May Holman Drive, Bassendean.

The retrospective land use of Motor Vehicles, Boat and Caravan Sales (Hire) in the General Industrial area where the subject site is located in is an ‘A’ use under the Local Planning Scheme 10 (LPS10) and pending Local Planning Scheme 11 (LPS11). This means that it requires advertising prior to the Town exercising its discretion and determining the application.

Success Hill Reserve Bushland Access Management and Hydrozoning - Targeted Survey

We want to hear from nearby residents, park visitors and others with an interest in Success Hill Reserve, to inform how we manage access to the bushland areas of the reserve and undertake hydrozoning to reduce water use. As Success Hill Reserve is a registered Aboriginal Heritage Site, all works will be subject to prior consultation with Traditional Owners and other relevant Aboriginal people, and approval under the amended Aboriginal Heritage Act 1972.

The State Government’s Perth and Peel @ 3.5 million land use planning and infrastructure frameworks aim to accommodate 3.5 million people by 2050, encouraging greater housing diversity to meet changing community needs.  Under this framework, the Town is required to facilitate at least 4,150 new dwellings, increasing the population to approximately 24,300 people.  The Town is reviewing its current planning framework to support this growth, whilst still maintaining a liveable community, protecting the area’s unique natural environment and heritage.

The previous application for a use not listed (short stay accommodation) at this address was refused by the Town’s Council on the 22 November 2022. The applicant has since appealed the decision to the State Administrative Tribunal. The State Administrative Tribunal aims to review the decision and attempts to achieve a resolution where there is a dispute. In this case, the applicant has provided amended information and therefore the SAT has invited the Town under Section 31 of the State Administrative Tribunal Act 2004 to reconsider its decision.
