TOWN OF BASSENDEAN PROPOSED LOCAL LAW

Activities in Thoroughfares and Public Places and Trading Local Law


The Town of Bassendean proposes to make a local law relating to Activities in Thoroughfares and Public Places and Trading.

The purpose and effect of the proposed Town of Bassendean Activities in Thoroughfares and Public Places and Trading Local Law 2026 is as follows:

Purpose of the local law:
To provide for regulation, control and management of activities in public places and thoroughfares (road reserves) within the district.

Effect of the local law:
To establish the requirements with which any persons using, or on, thoroughfares and public property within the district, must comply.

The proposed new local law was developed based on the model local law with amendments, with input from a range of internal stakeholders.

Model local law:
Model local laws are template documents, developed by the WA Local Government Association (WALGA), that provide local governments with a framework for creating their own local laws. They aim to help local councils draft consistent and compliant local laws.

Key components of the local law include activities in thoroughfares and public places (including vehicle crossings - temporary and redundant, verge treatments, fencing, signs erected by the local government, driving on a closed thoroughfare), advertising signs on thoroughfares, obstructing animals, vehicles or shopping trolleys and trading in thoroughfares and public places.

Variations to the model local law included:

  • Removal of activities already covered by the Local Government (Uniform Local Provisions) Regulations 1996 (WA) which includes offences for:
    • Interfering with, or taking anything from, land that is local government property without lawful authority
    • Placing on a public thoroughfare anything that obstructs it without lawful authority
    • Making an excavation in a public thoroughfare or land adjoining a public thoroughfare without lawful authority
    • Constructing anything on, over, or under a public thoroughfare or other public place that is local government property without lawful authority
  • Modifications to permissible verge treatments to provide consistency with the Town of Bassendean Verge Guidelines 2020, with new inclusion of option to consider play equipment on the verge under a permit (similar to Little Libraries and furniture)
  • Removal of Division 4 – Property numbers as this is determined by Australian Standards and State Government guidelines
  • Modifications to Part 3 Advertising signs on thoroughfares to provide consistency with signs on private property outlined in Town of Bassendean Local Planning Policy 16 Advertising and Signage
  • Removal of Part dealing with Roadside Conservation, as this is not relevant to an urban area.

A copy of the proposed law may be inspected at or obtained from the Town of Bassendean Customer Service at 35 Old Perth Road, Bassendean between the hours of 9.00am and 4.30pm, Monday to Friday. The proposed local law is also available below and a copy can be found in the Town’s library for reading.
