Trees on Private Property

In 2024, Council amended Local Planning Policy No. 13 – Tree Retention and Provision to introduce measures to protect trees on private property. We were the first local government in Perth to adopt the policy position and are proud to be leading the way in protecting not just public trees, but those on private land too.

This policy makes sure trees are considered at every stage of development — from planning to construction — so we can grow and protect our tree canopy for generations to come.

It specifically applies to ‘regulated trees’, which are trees that meet any of the following criteria:

  • Over 8 metres tall
  • Canopy wider than 6 metres
  • Trunk circumference of 1.5 metres or more (measured 1.4 metres above ground)
  • Not listed as a weed species.

If a tree on your property is listed on the Town’s Unwanted Species List or the State Weed Register, development approval is not required for its removal or other tree damaging activities.

‘Regulated trees’ cannot be removed (or substantially damaged) without first obtaining approval from the Town.

This is about protecting the trees that are already making a difference, and making sure future development works with nature, not against it.

The Town recommends any tree pruning to be undertaken by a qualified Arborist and seeking advice from a Consulting Arborist (AQF Level 5 Diploma in Arboriculture) where required.
