Development in the Floodplain

The Town of Bassendean seeks comment on its simplified draft policy on development within the floodplain of the Swan River.

Feedback is sought on the draft amended Local Planning No. 4 – Floodplain Management and Development (LPP 4) by Friday 25 September

Under State planning policy, decision makers must “consider flood risk by identifying floodways and land affected by 1 in 100-year flood events and avoid intensifying the potential for flooding as a result of inappropriately located land uses and development”.  

It is important to note that Council is not the decision-maker for subdivision within the floodplain but are generally the decision-maker for development.  If Council’s position differs from the Department of Water and Environmental Regulation (DWER), the Western Australian Planning Commission will decide.

The current policy provisions, which allow for development and/or subdivision of properties within the Flood Fringe but limited development or subdivision within the Floodway, remain largely unchanged. They reflect the views of both the Department of Fire and Emergency Services (DFES) and DWER.   These agencies have significant involvement in the issue of development within the floodplain as DWER is the custodian of the floodplain mapping and the DFES has responsibility for emergency management. Changes have been made to simplify the policy, remove supplementary information that is better provided in another form and provide greater clarity in decision making.

Importantly, Council’s decision relates only to the advertising of the draft amended Policy for public comment at this stage.  A final decision will only be made after the submission period.
