Meeting was requested by Alison Healey (Element) who is assisting the property owners with a Change of Use application for the site which they are hoping to submit in the near future. The application will be seeking to reflect the multi-purpose community, corporate, charity event opportunities that exist at the old warehouse. The purpose of the meeting was for the property owners to share their vision for the site. The meeting was attended by: Property Owners (VDA Holdings Pty Ltd) • Vince DiAngelo; and • Alley DiAngelo. Element (formerly TPG) Planning Consultants • Tony Paduano; and • Alison Healy. Vince and Alley DiAngelo took the opportunity to show Town of Bassendean representatives the existing building structures on site, including repairs that they have undertaken and construction works underway for an approved lunch bar on site along with ideas that they have for the building moving into the future. Tony Paduano and Alison Healy talked further about land uses that may be contemplated for the site (exhibition centre and functions were flagged as possibilities). Element will discuss further with staff from the Town in advance of submission of a formal application for development approval for a change of use.

Nature of Issue

Mr Bethune’s application for subdivision of his property at 184 West Road, Bassendean has been rejected by the SAT at a recent appeal hearing. Following this, Mr Bethune requested a meeting to discuss the Town’s current position on subdivision of properties, such as his, located in the floodway. Mr Bethune believes the Town’s failure to support the application was central to the SAT member’s determination. He questioned why, when Council resolved in August 2017 (OCM – 24/08/17*) to support subdivision in the floodway, that the local planning policy has not been updated and what the proposed timeline of this. Mr Bethune also requested that the Town contact the WAPC and amend their recommendation for refusal of subdivision for other similar properties based upon the August resolution. Mr Buttle agreed to meet with Mr Bethune to further discuss the EMRC flood results at a later date. *OCM – 24/08/17 MOVED Cr Brown, Seconded Cr Pule, that the Town of Bassendean supports subdivision in accordance with current zoning of those properties within the 100 year floodway situated on West Road and Whitfield Street, Bassendean. CARRIED 4/2 Crs Brown, Pule, Gangell & Lewis voted in favour of the motion. Crs Bridges & McLennan voted against the motion.

The Town’s local planning policy (LPP 4) relating to development in the floodway was developed based upon the advice provided by the former Department of Water and the Swan River Trust. Therefore, these agencies would also need to support subdivision in this location as it is not the Town that is the determining authority. Although the motion (OCM – 24/08/17) was carried, the local planning policy has not yet been through the formal process of being amended, endorsed by Council, advertised to the community and finally being adopted by Council. The Policy is a properly adopted policy under the Local Planning Scheme No. 10, and Council and officers are required to give due regard to the policy whilst making decisions until a new policy is adopted. Given that the EMRC flood study is due to be released in the next few months staff are awaiting the results of this study to be able to provide Council with an up to date report to inform the policy revision. It would be premature to present a report to Council before this information is released. It was suggested that instead of the Town contacting WAPC to seek the opportunity to provide a revised report on the current subdivision applications that Mr Bethune or the affected property owners contact WAPC and request that updated advice be sought.

David Briffa contacted me via email requesting a meeting to discuss a development proposal for Success Hill in conjunction with CUSP. Acton Real Estate has listed the properties at 8,10 & 12 Thompson Road for sale. Acton representatives have been approaching property owners in the surrounding location in an effort to secure a large land parcel for redevelopment as an activity centre. According to David Briffa there has been agreement from all of the owners in the land area bordered by Thompson Road, Lamb Street and the railway line and they are communicating with the owners of the remaining properties in the precinct extending west to Lord Street and south to Guildford Road. Acton and the owners of 8,10 & 12 Thompson Road are seeking rezoning of the properties in this area to RAC1with the aim of also developing the air space over the railway line in this region. Peter Newman is involved as the proposal involves having a fleet of vehicles available for residents to use on demand instead of each apartment having allocation for a private vehicle / car park. Acton are seeking endorsement from Council for the RAC-1 rezoning.

During a recent visit to the Curtin University Sustainability Policy (CUSP) Institute it was brought to my attention that CUSP was currently involved in a partnership looking at a sustainable development model in the Town of Bassendean. It was discovered that Mr Yates and Mr Briffa had been discussing the potential for a model development as part of the T.O.D.s. Mr Yates then requested the opportunity to meet to share the development concept he and Mr Briffa would like to propose for this area. Mr Briffa outlined the “living TOD community with local utilities” model. Mr Yates & Mr Briffa are keen to present a proposal based on this model to Council and have the identified development precinct incorporated into the intensification plans that will soon be developed by the Town’s strategic land use planner.

Is next Monday July 18 10:00am at Dome suitable for Councillors? Kind regards John. I responded that 10am didn’t suit me but that I could make it by 11am and suggested the Council offices would be a more suitable venue. I had no reason to question if it was a sanctioned meeting as we had met with an Hawaiian rep (male) in the Council chamber some time before on a parking matter, with staff in attendance, and I assumed this was an onsite continuation of this meeting. I attended the meeting with Councillors Gangell, McLennan, Pule and Lewis (Cr Brown was ill and no ToB staff were in attendance) and Alison and the formerly mentioned male attended from Hawaiian. They offered a coffee but I declined. Basically it was the same parking matter but this time plans were presented that showed what they proposed for the area in the upper carpark they wished to make a public space. Also presented were plans to convert part of Whitfield St road reserve to right angle parking to make up for the potential loss of the upper car park bays. I asked if they had discussed these plans with planning staff and they stated they had. My comment in response to ‘what did we think?’ was that we would consider this when the DA was presented and with officer comment and recommendations. Councillors Pule and Lewis then went with the Hawaiian rep/s to view the Whitfield St proposal and myself, Gangell and McLennan left.

The topic was to discuss parking and traffic management at the Bassendean Village Shopping centre. I assumed that our officers would attend, however,there were no Officers at this meeting. In attendance, from Hawaiian, there were Alison, the Regional Manager and the Centre Manager. I attended, together with Crs Gangell, Mclennan, Bridges and Lewis. Cr Brownreported ill and there were no officers from the Town of Bassendean at this meeting. Coffee was offered and I ordered and paid for my own. Discussion took place on a similar manner to the previous presentation by Hawaiian given at Council and with officers in attendance at that time. The discussion was about addressing establishing a public open space at the Dome end of the car park, re arranging the car park and right angle parking at Whitefield street. Also entry and exit positions from West road and Whitefield street . My response was to ask if these proposals, as presented, had been discussed with Town of BassendeanPlanning Officer and they responded that they had been discussed with Planning Officers. I inform Hawaiian that Councillors would need to again have further discussions with our Planning Officers and the CEO. I responded that Councillors and myself would discuss these matters with our Officers and that we would consider them when presented with Officer recommendations in our formal meetings. Crs Gangell, Lewis and myself inspected the Whitefield street area concerned and the car park with the Hawaiian Regional Manager. Cr Lewis and myself also discussed the clarity of no smoking signs at the Bassendean Village Shopping Centre with the Centre Manager and suggested better clarity signs. That was the end of this meeting.

I was aware that fairly recently, other councillors had met with Hawaiian representatives at the council offices with staff in attendance to discuss a parking matter. I was not in attendance at this previous meeting but expected that this particular meeting was an onsite continuation of this meeting. I attended the meeting with Councillors Gangell, Bridges, Pule and Lewis (Cr Brown was ill and no ToB staff were in attendance) and three Hawaiian representatives. A coffee was offered but I declined. The representatives presented a) Plans to convert part of the upper carpark into a public space with trees, seating & a play space with potential for hosting public events such as outdoor movies. I emailed Councillors to arrange a suitable meeting. The topic was to discuss parking and traffic management at the Bassendean Village Shopping centre. In attendance, from Hawaiian, there was Alison Reid, Jamie Nancarrow and Julie Purser from Hawaiian Pty Ltd. I attended, together with Deputy Mayor Cr Lewis, Cr Pule, Cr Bridges and Cr McLennan. Discussion took place on a similar manner to the previous presentation by Hawaiian given at Council. The discussion was about addressing establishing a public open space at the Dome end of the car park, arranging the car park and right angle parking at Whitefield Street. Also entry and exit positions from West road and Whitefield Street. I, along with Deputy Mayor Cr Lewis and Cr Pule inspected the Whitefield street area concerned with Jamie Nancarrow from Hawaiian.
