4.0 CONSIDERATION OF AN OFFER FOR THE PURCHASE OF THE MASONIC HALL SITE, LOTS 162, 164 AND 166 WILSON STREET, BASSENDEAN (CONFIDENTIAL)
4.1 Sale of Council Owned Land (Masonic Hall Site) by Private Treaty (Ref: COUP/ACQ-D/1 – M Costarella, Director Corporate Services and Ken Cardy, Contracts & Support Services Coordinator)
This matter was considered with members of the public excluded from the Chamber under Clause 5.23 (2) (c) and (d) of the Local Government Act 1995, as the Officer report discussed details of a proposed contract to be entered into.
The CEO advised that the prospective purchaser had advised that they had waived Condition 3 - due diligence clause from their offer which made the offer a cash offer and therefore the Officer Recommendation would be amended to reflect the change.
Cr Brinkworth expressed her concern at the possible breach in confidentiality that she believes has occurred following the receipt of the unsuccessful tenderer. Cr Brinkworth suggested that the unsuccessful tenderer was provided with confidential information.
COUNCIL RESOLUTION – ITEM 4.1
SCM1 - 1/7/10 MOVED Cr Brinkworth, that the recommendation as shown in the Confidential Minutes attached to the Special Council Minutes of 6 July 2010, be endorsed.

As no members of the public returned to the Chamber, the reading aloud of the motions passed behind closed doors was dispensed with.
